Generally, sexual harassment comes in two forms: (1) “quid pro quo” and (2) hostile work environment. Both derive from the statutory prohibition (codified in Title VII of the Civil Rights Act of 1964 and the New York State and City Human Rights Laws) against “discrimination” based on sex/gender. While these labels and accompanying definitions are relatively easy to state, their application to specific facts is often less straightforward.
